1. Agreement to These Terms

These Terms of Service (“Terms”) are a binding agreement between you and TruckShop411, located at 1519 47th Avenue, Moline, IL 61265 (“TruckShop411,” “we,” “us,” or “our”). They govern your access to and use of the TruckShop411 member platform at my.truckshop411.com, our website at www.truckshop411.com, and any related services, content, courses, events, and mobile applications (together, the “Services”).

By creating an account, checking the acceptance box during registration or checkout, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and Truthful Registration

The Services are intended for professionals in the heavy-duty truck repair, tow, and recovery industry and for vendors and other professionals who serve that industry. You must be at least 18 years old to create an account.

When you register, you agree to provide information that is accurate, current, and complete — including your name, company, and the role (“Member Type”) you select — and to keep it up to date. Misrepresenting your identity, your company, or your role in the industry (for example, registering as a Shop Owner or Shop Manager when you are not one) is a material violation of these Terms and is grounds for immediate suspension or termination of your account.

3. Membership and Accounts

Basic membership (“Shop Membership”) is currently offered free of charge. Free membership does not entitle you to any particular feature, and we may add, change, limit, gate, or discontinue any feature of the Services — free or paid — at any time.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Accounts are personal to you and may not be shared, transferred, or sold. If your account includes employee sub-accounts, you are responsible for the accounts you invite, and access for those sub-accounts is tied to the standing of your account and any associated subscriptions.

You may close your account at any time by contacting us at support@truckshop411.com.

4. Our Right to Suspend or Remove Members

Membership in TruckShop411 is a privilege, not a right. We reserve the right to suspend, restrict, or terminate any account, at any time, for any reason or no reason, with or without notice. This includes, without limitation, accounts that misrepresent who they are; accounts created to monitor, scrape, or gather competitive intelligence on the community or its members; conduct that harms or harasses other members; and any violation of these Terms. Except where required by law, we are not obligated to provide refunds upon suspension or termination, though we may choose to do so at our discretion.

5. Paid Products, Subscriptions, and Billing

Some products, features, content, courses, groups, and events are offered for an additional one-time fee or recurring subscription. For paid products:

• Auto-renewal. Subscriptions renew automatically at the end of each billing period and your saved payment method is charged until you cancel. You may cancel at any time from your account page or by contacting us; cancellation takes effect at the end of the current billing period.
• Pricing. The price of an active subscription remains at the rate in effect when you subscribed for as long as your subscription remains continuously active. We may change the price offered to new subscribers at any time. If your subscription lapses or is cancelled and you later re-subscribe, the then-current price applies.
• Refunds. Except as required by law or expressly stated for a specific product, payments are non-refundable, and no refunds or credits are provided for partial billing periods.
• Team access. Where a paid product extends access to your employee sub-accounts, that access is dependent on your subscription remaining active and on those sub-accounts remaining on your roster.
• Payment processing. Payments are processed by third-party payment processors (currently Stripe). We do not store full payment card numbers.

6. Community Conduct

TruckShop411 is a professional community. You agree not to:

• Harass, threaten, defame, or abuse other members;
• Post content that is unlawful, deceptive, obscene, or infringes anyone’s rights;
• Spam, solicit, or advertise outside of the channels and programs we provide for vendors;
• Scrape, harvest, copy, or systematically collect content, member data, or vendor program details from the Services;
• Share, resell, or republish members-only content, course materials, pricing programs, or vendor offers outside the platform;
• Interfere with the operation or security of the Services, or access them by automated means.

We may moderate, edit, hide, or remove any content at our discretion, and members may report content or block other members using the tools provided on the platform.

7. Your Content

You retain ownership of the content you post to the Services (posts, comments, messages, photos, videos, listings, reviews, and similar material). By posting content, you grant TruckShop411 a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content as needed to operate, promote, and improve the Services. You represent that you have the rights to the content you post. We are not responsible for content posted by members, and opinions expressed by members are their own.

8. Vendor Programs and Third-Party Offers

The Services include vendor directories, Member Advantage offers, rebates, buying programs, and other opportunities provided by third-party vendors and suppliers. These offers are made by the vendors, not by us. We do not guarantee the availability, pricing, quality, or terms of any vendor offer, and any purchase or agreement you enter into with a vendor is solely between you and that vendor. Participation in buying programs may require you to meet the vendor’s own terms and purchase requirements.

9. Training, Courses, and Certifications

Courses, certifications, and related training content are provided for informational and educational purposes. A TruckShop411 certificate reflects completion of a course on our platform; it is not a government license, an OEM authorization, or a professional credential, and we make no guarantee of any particular business or employment outcome. Heavy-duty vehicle repair is inherently dangerous — always follow applicable laws, OEM procedures, and shop safety practices. You are solely responsible for work performed in your shop.

10. Intellectual Property

The Services and all content we provide — including courses, videos, documents, logos, and software — are owned by TruckShop411 or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your own business purposes while your account is in good standing. You may not copy, distribute, sell, or create derivative works from our content without our written permission.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services you consent to that collection and use.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT, ADVICE, OR INFORMATION OBTAINED THROUGH THE SERVICES IS ACCURATE OR RELIABLE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKSHOP411 AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS ($100) IF YOU HAVE PAID US NOTHING.

14. Indemnification

You agree to indemnify and hold harmless TruckShop411 and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, your violation of these Terms, or your violation of any rights of another party.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in Rock Island County, Illinois, and you consent to the jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page and, for material changes, take reasonable steps to notify members. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

1. Who We Are

TruckShop411, located at 1519 47th Avenue, Moline, IL 61265 (“we,” “us,” or “our”), operates the TruckShop411 member platform at my.truckshop411.com and the website at www.truckshop411.com. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the member platform. The marketing website at www.truckshop411.com has its own privacy policy.

2. Information We Collect

2.1 Account and Registration Information

When you create an account, we collect the information you provide during registration: your name, username, email address, password, company, phone number, website, billing address, and the Member Type you select. If you were invited as an employee sub-account, the shop owner or manager who invited you provided us your email address for that purpose.

2.2 Payment Information

When you purchase a paid membership, subscription, or product, payments are processed by our third-party payment processor (currently Stripe). We receive and store transaction records (what you purchased, when, and the amount) and a payment-method reference, but we do not store your full card number. Stripe’s handling of your information is governed by its own privacy policy.

2.3 Profile and Community Content

The platform is a professional community. Content you add — profile details, photos, activity posts, comments, forum discussions, group content, marketplace listings, reviews, and messages — is collected and stored so we can display it as intended. Your profile and most community content are visible to other logged-in members; the platform is not open to the general public. Private messages are visible to you and your recipients, though we may access them where necessary for moderation, security, or legal compliance.

2.4 Training and Certification Activity

When you take courses, we collect enrollment, progress, quiz, completion, and certification data. Certificates you earn include your name and course details, and achievement badges may be visible to other members on your profile. Certificates include a QR verification code; anyone with a certificate’s verification link can confirm the certificate holder’s name, course, and completion date through our public verification page.

2.5 Usage Data and Cookies

We use cookies and similar technologies that are necessary for the platform to function — keeping you logged in, remembering preferences, and maintaining security. We may also use analytics tools to understand how the platform is used in aggregate so we can improve it. You can adjust your browser to decline cookies, but parts of the platform may not function without them.

3. How We Use Your Information

We use the information we collect to:

• Create and manage your account and authenticate you;
• Provide the platform’s features, including community, training, vendor programs, and events;
• Process payments and manage subscriptions;
• Manage employee sub-accounts and team access;
• Send service communications (account, billing, and feature notifications) and, where you have opted in, marketing communications you can unsubscribe from at any time;
• Moderate the community and enforce our Terms of Service;
• Analyze usage in aggregate to improve the platform;
• Comply with legal obligations.

4. How We Share Your Information

We do not sell your personal information. We share it only with:

• Other members, to the extent your profile and content are visible on the platform as described above;
• Your shop’s account owner, if you are an employee sub-account (they can see roster and training-related information for their team);
• Service providers that help us operate the platform — such as payment processing (Stripe), hosting (Kinsta), and email delivery — under terms that limit their use of the information;
• Vendors, only when you choose to participate in a vendor’s program or offer and that participation requires it;
• Legal authorities, where required to comply with applicable law or to protect our rights or others’ safety.

5. How Long We Retain Your Data

We retain your information for as long as your account is active and as needed to provide the platform. Transaction records are kept as required for tax, accounting, and legal purposes. If you close your account, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law or where content must be preserved to maintain the integrity of community conversations (in which case it is anonymized).

6. Your Rights Over Your Data

Depending on where you reside, you may have the right to access, correct, or delete the personal data we hold about you; to object to or restrict its processing; and to not be discriminated against for exercising your privacy rights. You can update most of your information directly in your account settings. For anything else, contact us using the details below and we will respond within a reasonable timeframe and in accordance with applicable law. If we decline your request, you may appeal by contacting us, and depending on your state of residence you may also have the right to contact your state attorney general.

7. Security of Your Data

We take reasonable administrative, technical, and physical measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of internet transmission or electronic storage is fully secure, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential.

8. Children’s Privacy

The platform is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If you believe we may have collected information from a child, please contact us immediately.
